On December 1, 2017, a new type of rental – private residential rent – came into effect, replacing secure and short-term leases for all new leases. We have a lease and a retirement contract for the owners. Owners can also create their own, provided they contain the minimum information required by law. Short-term leases can be written or oral, but we recommend the use of written leases. Owners and tenants can use our Form 1 – Rental Agreement (Word, 1.5MB). If the tenant moves before the end of the contract, they may be forced to pay the cost of the break rent. If a landlord has another type of rental agreement, he must give his tenant the following instructions: For a person: Write his full legal name on the rental agreement. Landlords must verify the identity of the tenant before moving in. You can download our rental application form before below.

Leases must be established in writing and the lessor must give a copy to the tenant before the lease begins. However, even if there is no formal written agreement, the Housing Act applies. Landlords and tenants cannot evade their obligations by not providing their agreement in writing. Download the rental agreement below. Download the rental agreement below. There are six initiations/forms that are stipulated in the legislation and which must be used for specific purposes when a tenant has a private lease. These include an exit notice and a communication on rent increases. Additional terms and conditions may be included and the agreement must comply with the Residential Tenancies Act 1997. The group made a key recommendation, namely to replace the current secure leasing regime with a new leasing regime for all future private sector leases. The group also agreed that the new lease should offer clarity, simplicity, ease of use and flexibility. Each rental agreement must contain the following: Owners cannot simply include conditions they wish in the lease.

All additional conditions must be in accordance with the law. Regular leases (234.7 KB PDF) do not have a date when the lease expires. They will continue until the tenant or landlord announces in writing the termination of the lease. The lessor must terminate at least 90 days in writing to terminate a periodic agreement (269.9 KB PDF) for no particular reason, or may give 60 days of written notification if: A lease is a contract between you and an owner. The rental agreement will indicate how much rent you have to pay, how often you have to pay it and other conditions. You must ensure that you understand the terms of the lease before signing it. A rental agreement is a mandatory contract between you and the owner and contains important information about the terms of the lease.
